Dealing with VA malpractice is different from a public doctor or hospital, because claims against the VA are regulated by the Federal Tort Claims Act. The FTCA regulations state that all malpractice claims must begin with the filing of a Standard Form 95 along with pertinent supporting medical information. This is submitted to the government, but while being investigated the plaintiff cannot sue the VA in court.
Once the Form 95 is entered into the system, the government has six months to review it and either allow or deny the claim. After a claim is denied, the plaintiff has six months to file a lawsuit in Federal Court. If the government takes longer than six months, the plaintiff is still permitted to file the Federal lawsuit.
